Democrats Sue to Block Georgia Republicans Effort to Pervert the Electoral System

The Republican-controlled State Election Board recently adopted Trump-inspired rules design to subvert the will of the majority in elections. The new rules enhanced the power of local election board members to call for an investigation of the conduct of elections. A challenge from a single Board member could delay formal certification of the returns and send the electoral system into chaos. Republicans hope to exploit the chaos to skew the vote in favor of Republicans.

  • The state and national Democratic parties are suing to block two recent rules adopted by Georgia's State Election Board
  • The lawsuit says the rules defy state law that says county officials “shall certify” results, and that more than a century of court precedent in Georgia leaves county officials with no wiggle room the Republicans are attempting to create.
  • "...these rules rest on the assumption that certification of election results by a county board is discretionary and subject to free-ranging inquiry that may delay certification or foreclose it entirely. But that is not the law in Georgia” states the lawsuit, filed in Fulton County Superior Court.
  • Alleged fraud or misconduct should be handled by the courts, not by county officials as they tally results, the suit argues, citing more than a century of Georgia court rulings.
  • A Democratic state senator and the former chair of the Fulton County elections board have both sent letters demanding that Governor Kemp remove the three Trump-aligned members for violating state ethics laws.
